The learned counsel for the respondents raises a preliminary objection to the tenability of the writ petition. It is stated that without availing the alternate remedy of filing an appeal before the tribunal, the petitioner has filed the instant writ petition.
Ms Athalye, learned counsel for the petitioner on instructions from the petitioner seeks permission to withdraw the writ petition as the petitioner intends to avail the alternate remedy.
