In view of provisions of Section 34(3) of the Maharashtra Rent Control Act, 1999, the learned Counsel for the appellants seeks permission to withdraw the second appeal as the same is not maintainable. He submits that the decree for eviction is being executed and there is likelihood of the appellants losing possession.
Second appeal is permitted to be withdrawn with liberty to file appropriate proceedings in accordance with law. The decree for eviction shall not be executed for a period of two weeks from today.
