Mr. Mirza, learned Counsel for the petitioner submits that due to passage of time, the applications filed by the petitioner seeking permission for establishing a new Medical institution has now become infructuous and the petitioner would be required to make fresh application in that regard. He, therefore, seeks leave of this Court to withdraw the instant petition with liberty to make fresh application and further seeks permission of this Court to withdraw the amount of 10,00,000 (Rupees ten lakhs) already ₹ deposited by the petitioner in this Court.

Leave with liberty as prayed for, is granted. Permission to withdraw 10 lakhs already deposited by the petitioner in this ₹ Court with accrued interest, if any, is also granted. 3.
