The petitioner, daughter of deceased employee, seeks employment on compassionate ground with respondent No.2.

Advocate Jagdale submits that she is presently working with the respondent No.2. He adds that respondent no.2 has forwarded the suitable proposal to respondent No.3Education Officer and if the same is considered, the grievance of the petitioner will be redressed.

Learned AGP for Respondent No.3 - Education Officer (Secondary), Amravati, states that if any such proposal is received, it

wp4455.16.sxw shall be processed and considered in accordance with law within the reasonable time.

Advocate Saboo points out that the employment provided to the petitioner was on contract basis. There are already surplus teachers with respondent No.2 and hence, it may not be possible to provide employment on compassionate ground.

However, a proposal with necessary details has been sent for evaluation to the Education Officer.

Availability of posts, entitlement of petitioner are all issues which can be looked into by the respondent No.3. We direct that authority to consider the proposal forwarded by respondent No.2 as per law within next three months.

With these directions and keeping all rival contentions open, we dispose of the writ petition. No costs.
