I have heard learned Counsel for the applicant to some extent. Perused the investigation papers. One of the ground raised in the application is delay in trial. 3.

On perusal of the entire roznama it reveals that due to the absence of the Counsel of the accused the trial delayed. Therefore, the ground of delay in trial is not available to the present accused.

On pointing out this, learned Counsel for the applicant seeks permission to withdraw the application. 5.

Permission is granted.
