The petitioner has approached this Court being aggrieved by the criteria fixed by the Nagpur University which prescribes that a candidate seeking admission to Mass Communication course must possess 45% of marks in Graduation degree.

It is the contention of the petitioner that there is no such criteria determined by Bombay University and as such, the action of the respondent no.1 is discriminatory in nature. As to what should be the criteria for seeking admission to a particular course is exclusively within the domain of the experts body like the respondent no.1 University. The criteria fixed for admission may differ from University to University. Not only that but in one city also the marks obtained by a candidate seeking admission in the qualifying examination may differ to a great extent. In a college having the highest reputation, a student may not be in a position to get admission even if he does

get 90% of marks in a qualifying examination. As against this, in another college a candidate may get admission even if he gets 35% of marks in qualifying examination.

In that view of the matter, we find that the contention as raised in the petition is without merit. The petition is, therefore, rejected.
