Transfer is sought on the ground that the Court which took cognizance did not have the territorial jurisdiction to do so.
2] If the Court indeed lacked the jurisdiction, application under section 407 of the Criminal Procedure Code is not the remedy. The learned counsel seeks leave to withdraw the application with liberty to avail such remedy as is available to the applicant in law to challenge the order of taking cognizance.
