Shri K. Tople, learned counsel for the petitioners on instructions submits that if the directions issued by the Additional Commissioner in the order dated 16.04.2019 of removing the encroachment are implemented expeditiously, the grievance of the petitioners would not survive. He further submits that by the same order, liberty has been granted to the petitioners to prove the existence of the cart-way to approach their respective fields. In view of aforesaid statement, the writ petition is disposed of by directing the Tahsildar to expeditiously implement the directions as issued if there are no other legal impediments. The Additional Collector to ensure that the aforesaid directions issued in the order dated 16.04.2019 are expeditiously carried out. No costs. Authenticated copy of this order is granted to the learned Assistant Government Pleader.
