Heard.

The applicant is arrested on 24th January, 2017 in connection with Crime No.28/2017 registered for the offence punishable under Sections 302, 201 and 120-B of the Indian Penal Code.

The application is opposed on the ground that there is ample material available with the investigating agency which shows the involvement of the applicant in the commission of the crime.

The learned Advocate for the applicant has submitted that even if the claim made by the investigating agency is accepted, at the most, offence punishable under Section 201 of the Indian Penal Code will be made out against the applicant.

The applicant, aged about 26 years, claims to be student of 3rd year of Bachelor of Engineering Course and has stated that he is not involved in any other crime / offence. The investigation is complete,

2 ba669.17 charge-sheet is filed and the non-applicant has not been able to point out that further custody of applicant is required for investigation.

Considering the facts of the case, following order is passed:

The applicant having been arrested in connection with Crime / F.I.R. No.28/2017 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.50,000/- ( Rs. Fifty Thousand) and furnishing one solvent surety in the like amount. The applicant shall surrender his passport to the investigating agency within one week.

The application is allowed accordingly.
