DATED : 16-09-2016 Considering the facts of the case, the claimant is permitted to withdraw Rs.10,00,000/- on filing an undertaking before the learned Registrar (Judicial) of this Court that if at the time of hearing it is found that the claimant is not entitled for the amount withdrawn by him, he will redeposit the amount alongwith interest as may be determined by this Court within two months. The balance amount be given to the claimant on furnishing solvent surety/security to the satisfaction of the learned Registrar (Judicial) of this Court. The civil application is allowed in the above terms.
