Apprehending arrest in connection with Crime No.0188 of 2017, registered for the offence punishable under Section 376(ii) of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act, the applicant seeks pre-arrest bail.

The crime is registered on the complaint lodged by victim (aged about 16 years) that taking advantage of acquaintance and assuring to marry with her the applicant has sexually assaulted the victim. According to the victim, on 26th June, 2017 at about 03.00 hrs. she went out of her house on being called by the accused, the accused took the victim on the roof(slab) of his house and sexually assaulted her. The complaint is lodged on 26th June, 2017 at about 19.00 hrs. Be that as it may, the non-applicant has not been able to point out that custody of the applicant is required for investigation. The applicant, aged about 30 years, claims that

2 aba508.17 he is in private service and is not involved in any other crime/ offence.

Considering the facts of the case and nature of accusations against the applicant, following order is passed: In the event of arrest in connection with Crime No.0188 of 2017, registered by the non-applicant, the applicant be released on bail on executing P.R. Bond for Rs.Twenty Thousand.

The application is allowed accordingly.
