By this petition, the petitioner seeks a direction to the respondent No.4-Scrutiny Committee to decide the caste claim of the petitioner within a time frame. The petitioner also seeks the protection of his education in the engineering course till his caste claim is decided.
Ms Udeshi, the learned Assistant Government Pleader appearing on behalf of the Scrutiny Committee, states that the caste claim of the petitioner is pending before the Scrutiny Committee and the matter is referred to the Vigilance Cell for enquiry.
In view of the statement made by the learned Assistant Government Pleader in respect of the pendency of the caste claim, we dispose of the writ petition with a direction to the respondent No.4-Scrutiny Committee to decide the caste claim of the petitioner as early as possible and positively within a period of one year. Since the petitioner was not at fault in not producing the caste validity certificate, the education of the petitioner is protected till his caste claim is decided. Order accordingly. No costs.
