DATED : 24-07-2018 The applicant, who is in custody since 16-7-2017 in connection with Crime 387/2017 registered at Police Station Kalamna, Nagpur for offences punishable under Sections 392, 395, 120-B and 201 read with Section 34 of the Indian Penal Code and Section 3 of the Maharashtra Control of Organized Crime Act ("MCOC Act" for short) is seeking enlargement of bail on the ground of parity.

The submission is that the role of the applicant cannot be distinguished from that of co-accused Sanjay Netam who is granted bail by this Court by order dated 02-7-2018 in Criminal Application (BA) 388/2018. 3.
In all fairness, the learned Additional Public Prosecutor Shri T.A. Mirza does not dispute the said submission.

As a fact as is fairly pointed out by the learned Additional Public Prosecutor Shri T.A. Mirza, the case of the applicant appears to be on a better footing than that of co-accused Sanjay Netam who is released on bail by this Court. The application will have to be allowed. 5.
The application is allowed.

The applicant be released on bail on furnishing personal bond of Rs.15,000/- with one solvent surety of the like amount.
8.
The applicant shall not tamper with the prosecution evidence nor shall attempt to influence the witnesses in any manner.
