Heard Mr. A.V. Bhide, learned counsel for the Applicant and Ms. Udeshi, learned APP for the respondent-State.

The applicant is apprehending his arrest in connection with Crime No. 88/2015 registered with Police Station, Babhulgaon, Distt. Yavatmal, for the offence punishable under Section 307 read with Section 34 of Indian Penal Code.

The First Information Report is lodged by Rambhau, who is injured. According to the First Information Report, on 25th May, 2015, when the first informant had been to village Kolhi, the applicant and other co-accused assaulted him by means of a stick. The present applicant and injured are in relation with
each other. The allegations against the father of present applicant Ramrao and the present applicant show that both of them have assaulted first informant by means of a stick on his head. The Injury Report shows only one injury on the head. Further, the stick used by Ramrao is already seized by the police at his behest.

The applicant is not having any criminal past record at his discredit. Looking to the nature of the accusations made in the First Information Report, I see no reason to deny the relief as prayed for. That leads me to pass the following order:-
O R D E R
[a] Criminal Application [ABA] No. 420 of 2015 is allowed.
[b] The Applicant - Tushar Ramrao Gade be released on bail in the event of his arrest in connection with Crime No. 88/2015 registered with Police Station, Babhulgaon, Distt. Yavatmal, for the offence punishable under Section 307 read with Section 34 of Indian Penal Code on he executing a Personal Bond of Rs.5,000-00 [rupees five thousand only] with one solvent surety.
[c] The Applicant shall attend the Police Station
twice a week on every Wednesday and Monday from 3.00 p.m., to 5.00 p.m.
With this, the application is allowed and disposed of.
