DATE : AUGUST 28, 2017 By this application it is prayed that the decree for partition and separate possession be stayed during pendency of the appeal. In the application it is stated that as per the decree passed by the appellate Court, the suit property is likely to be partitioned. On 01/08/2016, this Court directed the parties to maintain status quo while issuing notice. No reply has been filed on behalf of the respondent.

By clarifying that though the process of partition may go on by marking the shares, possession of the parties shall not be disturbed during pendency of the appeal. Civil application is disposed of.
