In substance, applicant seeks to recall the order of this Court dated 06.12.2021 by which original application was came to be dismissed for want of compliance of office objections.

It is submitted that minor office objection remained to be complied of which the applicant was not aware. It is submitted that applicant was under impression that in terms of order of this Court dated 02.11.2021, the matter is for service of notice on informant.

The applicant undertakes to deposit amount of Rs.1,000/- with High Court Legal Services SubCommittee, Nagpur to show his bona fides.

In view of the above, both applications are allowed with the condition that, order dated 06.12.2021 to the extent of this criminal application is hereby recalled.

The criminal application is restored at its original stage on condition that the applicant shall deposit the said amount within one week from today. CRIMINAL APPLICATION NO. 1220 OF 2021 1.

After restoration of the application, issue fresh notice to respondent no.2 i.e. informant.
