This Court on 26.10.2021, while granting ad-interim anticipatory bail to the applicant had observed that the learned counsel for the applicant, upon instructions, made statement that the applicant would deposit amount of Rs.1,72,357/- in this Court to show his bonafides.

Today, Shri Bisen, learned counsel for the applicant fairly states that the applicant has not deposited the amount as per the statement of the applicant made on 26.10.2021.

Shri Thakare, learned APP submits that even the applicant failed to attend the concerned Police Station C.L.Dhakate

7.aba.704.2021.odt regularly as directed by this Court. It is submitted that there is breach of order of granting ad-interim protection to the applicant.

On perusal of the police diary, it appears that though there was injunction restraining the applicant to deal with the property in question, he has accepted huge amount from various prospective buyers and thereby cheated them. Thus, prima facie incriminating material is available to show the involvement of the applicant in the alleged offence. Moreover, as the applicant has failed to comply with the conditions as imposed in the order dated 26.10.2021, granting ad-interim anticipatory bail to the applicant, the application is rejected.
