The investigation in this case is still going on as the statements of some of the witnesses are yet to be recorded. It is seen from the record of the prosecution as well as what is submitted before this Court by the learned A.P.P. that statement of not a single person from village Wanoja has been so far recorded although specific reference to these persons has appeared in the complaint filed against this applicant. That is a surprising thing.
Learned A.P.P. to seek instructions from the investigating officer on this aspect of the matter. Leave to file additional reply is granted.
Stand over to 08/8/2016.
Meanwhile, the interim protection would have to be granted to the applicant. Therefore, it is directed that in the event of arrest of the applicant in Crime No.147/2016 registered against him at police station, Manora for the offences punishable under Section 376 and 506 of the Indian Penal Code, the applicant shall be released on bail on his furnishing a P. R. Bond in the sum of Rs.20,000/- together with one solvent surety in the like amount on the conditions that the applicant shall attend police station Manora as and when required, he shall cooperate with the police in the investigation and shall not tamper with the prosecution witnesses. This order shall remain valid until further orders.
