By this writ petition, the petitioner has challenged the list of surplus teachers (Primary), that was prepared by the respondent-Zilla Parishad as per the new staffing pattern.

Shri R.D.Karode, the learned counsel for the petitioner, states that during the pendency of the writ petition, by a communication, dated 29.07.2016, the Chief Executive Officer, Zilla Parishad, Akola has informed the Block Development Officers and Block Education Officers of all Panchayat Samitis that since the issue is being discussed with the Association of Teachers, the action of absorption of the surplus teachers is presently stayed. It is stated that since no action is being taken against the surplus teachers, that are included in the list, that is challenged, the cause for filing the writ petition would not survive, at this stage.

In view of the aforesaid statement, we dispose of the writ petition with no order as to costs.

The petitioner would be at liberty to file appropriate proceedings, if need be, in future.
