Heard Advocate Ms. S.B. Khobragade for petitioner and Learned A.P.P. Shri M.J. Khan for respondents. The petitioner was required to be arrested in 2010 as he did not report for 96 days and, thereafter, in 2012 as he did not report for 93 days, when released on furlough leave. Police verification report shows that the relatives of the petitioner are ready and willing to stand as surety. His father is also ready to stand as surety. It is pointed out that his father, however, is not competent to control him.
In this situation, we direct petitioner to furnish surety of his father as also surety of another independent relative and to deposit an amount of Rs.20,000/- as cash security before his release.
The respondents shall obtain appropriate bonds from petitioner as also his surety and, thereafter, shall release him on furlough leave. During furlough leave, petitioner shall report at concerned Police Station once in every three days and shall not travel out of its jurisdiction.
Writ Petition is thus partly allowed and disposed of. JUDGE JUDGE Gulande
