The applicants are apprehending arrest in Crime 368/2018 registered with the Police Station Gadge Nagar, Amravati for offence punishable under section 420 read with section 34 of the Indian Penal Code.

2] Applicant 1 is the father of Atul Lavhale and applicant 2 - wife of Atul Lavhale, who concededly is the main accused.

3] Atul Lavhale is absconding and for reasons inexplicable the Amravati Police have not till date managed to apprehend Atul Lavhale.

4] The material on record including the first information report would reveal that prima facie Atul Lavhale has indeed cheated the complainant.

aba508.18.O.odt 2 The complainant was induced to pay a huge amount of Rs.74,90,000/- in cash to Atul Lavhale. However, the material on record including the first information report is prima facie not sufficient to connect the applicants to the crime. This of course a prima facie observation.

The application is allowed.
