Shri S.S.Doifode, A.P.P. for Respondent.

CORAM : B.P.DHARMADHIKARI AND KUM. INDIRA JAIN, JJ.

DATED : DECEMBER 01, 2016.

1.

The matter is being considered by this Court since long. Some affidavits have been placed on record by the Investigating Officer as outcome of the said hearing. The affidavits prima-facie demonstrate that the proceedings were not closed as was being urged by Advocate Shri P.P. Patil. On last date of hearing Advocate Shri Patil informed that his client wishes to change advocate. At the request of Shri Patil, we adjourned the matter for today, however, advocate Patil is absent.

2.

Advocate Shri A.B.Moon has filed Vakalatnama for the petitioner. Advocate Moon submits that sanction in the matter is not by the competent authority. 3.

Thus, altogether different point is sought to be urged and it needs to be noted that in Criminal Application No. 227 of 2015 present petitioner had raised this ground and on 6th July, 2015 we have disposed of that application. We have also observed that the contention can be looked into at an appropriate stage.

2 wp602.16 4.

In the present facts, we, therefore, dispose of the present writ petition.

Needless to mention that we keep all the contentions open and give the petitioner liberty to raise it before the trial Court at an appropriate stage. JUDGE JUDGE RRaut..
