This is an application seeking withdrawal of the amount of Rs.1,60,79,434/- deposited by the respondent No.3 - acquiring body in this Court. Earlier, by an order of this Court dated 05.08.2019 in First Appeal No.631/2019, partly allowing the appeal of the applicant, this Court had directed deposit of the said amount. However, since the respondent No.3, had failed to deposit the amount, Contempt Petition No.64/2022, was filed in this Court and pursuant to orders of this Court, the said Prity
2 / 2 38.can90.2022 amount came to be deposited in this Court vide Demand Draft dated 26.07.2022. Although, on the last occasion, time was sought to file a reply, however, Mr. Kadu, on instructions, states that since the amount has already been deposited in compliance of the orders of this Court, it may not be necessary to file reply in the matter and the amount deposited in this Court may be allowed to be withdrawn.

Having heard the learned counsel for the petitioner and having perused the papers and proceedings in the matter, let the amount of Rs.1,60,79,434/-, be allowed to be withdrawn along with interest, if any, by the applicants. Registry to act accordingly.

In view of the aforesaid order, nothing survives in the contempt petition.

The civil application accordingly stands disposed.
