This is an appeal against acquittal. Respondent No.1 was acquitted by learned Judicial Magistrate First Class of the offence under Section 138 of the Negotiable Instruments Act, 1881 on 28.6.2006 in Criminal Case No.8406/2005.

The appeal was admitted.

The appellant has filed a Pursis bearing No.1899/2018. The said is signed by appellant Khushalpalsingh Varma and his Advocate. By the said Pursis, it is pointed out to this Court that the appellant is not interested in prosecuting the appeal. Therefore, learned counsel Shri S. Jaggyasi for the appellant submits that the appellant does not wish to press the appeal, therefore, necessary orders be passed.
