Heard Mrs. A.A. Ghonge, learned counsel [appointed] for the petitioner and Shri J. Ghurde, learned A.P.P. for respondents. Perused reply. 2.

Reply shows that the petitioner has been categorized and placed in Category 3[d] of the directions dated 11.05.1992. Thus, he has to put in 26 years in prison.

Learned A.P.P. submits that this categorization by the respondent nos.2 and 3 is yet to be finally approved by the respondent no.1 - State

Order 2811wp603.16 Government.

Grievance of learned counsel [appointed] for the petitioner is at a young age of 20 years, he was convicted and sentenced to life imprisonment. His categorization therefore, ought to have been done immediately and he has been made to suffer unnecessarily. We keep the said contention open. 5.

In this situation, we direct the respondent no.1 to take final decision on the categorization of petitioner within a period of three months from the date of communication of this order to it.

Criminal Writ Petition is, thus, partly allowed and disposed of. No costs.

Fees payable to the learned counsel [appointed] for the petitioner is quantified at Rs.1500/-.
