There are no criminal antecedents to this applicant as is stated in the reply. Learned A.P.P., however, points out from the case-diary that there is similar offence registered against this applicant recently. However, so far as the facts disclosed by the casediary are concerned, I find that there is a doubt about this applicant having conscious possession of the illicit liquor and if this is so, registration of the previous crime, would not be an obstacle for grant of anticipatory bail to this applicant. Even otherwise, the illicit liquor has already been seized and major part of the investigation is over. Therefore, this applicant is now entitled to be released on anticipatory bail. Hence, the order.:

The application is allowed and the interim bail granted to the applicant by this Court on 05/8/2016 is hereby confirmed on the same conditions except for the conditions regarding his attendance and now the applicant shall attend the police station as and when required.
