In this petition, the order 17.03.2022 directing to assign lighter job to the respondent-complainant, is under challenge. 3.

The learned counsel for the petitioner submits that after the impugned order dated 17.03.2022 was passed by the Industrial Court No.2, Nagpur, the respondent is not attending his duty. However, on a query put to the learned counsel for the petitioner, whether any action was taken against the respondent for not attending the duty despite the fact that the petitioner is ready to assign lighter job, a reply was in negative. 4.

The learned Industrial Court, after considering the medical report and other relevant documents, has arrived at a conclusion that the respondent needs to be assigned lighter job and accordingly, the impugned order was passed.

Nothing has been pointed out in this petition which warrants interference. As far as the alleged conduct of the respondent that, he is not attending the duty, despite the lighter job has been assigned, the petitioner has other remedies to deal with. However, the said ground is not sufficient to set aside the impugned order. Accordingly, the writ petition is dismissed. [ANIL S. KILOR, J.] nd.thawre
