Heard Shri S.D. Mane, petitioner- Inperson and Shri Ghate, learned Counsel for respondent no.2 Bank.

We find that the pendency of revision under Section 44 of the Maharashtra Recognition of Trade Union and Prevention of Unfair Labour Practice Act, filed by the petitioner before the Industrial Court at Nagpur is not in dispute.

Shri Mane, petitioner submits that he was joined before Labour Court in proceedings under Section 48 [1] of the above Act in personal capacity

Order 2107wp4694.17 and against that order, he has filed a revision. The said revision is pending since last more than 3 years and he has already been superannuated.

In this situation, considering the facts we direct the Industrial Court to decide said revision at the earliest and in any case within a period of three months from the date of receipt of this order. Petitioner to communicate this order to the Industrial Court.

Writ Petition is accordingly disposed of. No costs.
