Learned A.P.P. for the State submits that no cogent reason has been given by the applicant. However, upon perusal of the roznama as well as the grounds taken in the application filed before the trial Court, I find that absence of the applicant on 24/6/2016 before the trial Court could have been due to some misunderstanding on his part. Almost on all the previous dates, as seen from the roznama, this applicant was present before the trial Court. If, such is the conduct of the applicant, there is no reason for me to outrightly reject the explanation given by him for his absence before the trial Court.

The application is, therefore, allowed and it is directed that the applicant be released on bail on his furnishing P. R. Bond in the sum of Rs.20,000/- together with one solvent surety in the like amount on the conditions that he shall regularly attend the Court on the dates fixed in the matter, he shall cooperate with the Court in expeditions disposal of the case against him and shall not tamper with the prosecution witnesses.
