This is an application seeking condonation of delay of 875 days to bring on record the legal heirs of original appellant.
Considering the length of the delay, learned counsel for appellant Shri R.J. Shinde fairly concedes that appellant will not claim the interest for the period of 875 days.
In view thereof, application is allowed. The delay of 875 days is condoned subject to condition of appellant being not entitled to get the interest on the enhanced amount of compensation of this delayed period of 875 days.
Appellant to carry out necessary amendment within two weeks to bring the legal heirs on record.
2407 FA 308-2008 2/2 Application for setting aside abatement and permission to that to bring legal heirs on record is accordingly allowed.
All these applications are disposed of accordingly.
