Learned counsel for appellant points out that this appeal was kept for taking steps to bring on record the legal heirs of respondent no.1. However, appellant has filed the Pursis stating that respondent no.2 who is the only legal heir of respondent no.1, is already on record, and hence there is no need to take any further steps.

In view thereof, appellant to carry out necessary amendment in the clause title of appellant of the appeal memo, to delete the name of respondent no.1 and to specify against respondent no.2 that he is sued in the individual capacity as well as legal heir of Saraswatabai.

This necessary amendment to be carried out within two weeks.

As the entire amount of compensation is deposited, the order of interim stay is confirmed till decision of the appeal.
