DATED : AUGUST 21, 2019 Heard Mr. Thakur, learned counsel for applicant and Mr. Ghurde, learned A.P.P. for non applicant-State. Also persued charge-sheet. Seen the statement of injured Rahul. The applicant is aged about 20 years and is in jail since one year. This Court has released one of the co-accused on bail. Learned counsel for applicant would submit that though the case is committed to the Court of Sessions, charge is not framed.

Incident is dated 14.07.2018. Injured was already discharged form hospital and thus there is no possibility that the offence may be further aggravated. Looking to the age of applicant and the fact that he is languishing in jail for one year and there is no possibility of the trial being taken up in near future, I pass the following order.

ORDER

(i) The application is allowed.

(ii) Applicant-Saurabh s/o Sudhir Wasnik be released on bail in connection with Crime No.445/2018 registered with Police Station, Pachpaoli, Nagpur for an offence punishable under Section 307, 120 (B), 143, 144, 147, 148, 149 of the Indian Penal Code and Sections 4 and 24 of the Arms Act, on he executing P.R. Bond in the sum of Rs.25,000/- with one solvent surety in the like amount. (iii) The applicant is directed to attend Police Station, Pachpaoli, Nagpur, twice a week i.e. on every Monday and Thursday and shall be in Police Station from 01.00 p.m. to 07.00 p.m., till the trial is culminated.

The application is disposed of.
