Considering the peculiar set of facts, it would be proper to partly allow the application. As such, the application is partly allowed.

Registry is directed to pay 75% amount along with interest accrued thereon to the claimant/respondent no. 1 on furnishing usual undertaking.

Accordingly, the application stands disposed of.

63=CAF 2051-24 in FA 686-24.odt FIRST APPEAL NO. 686 OF 2024 The learned counsel for the respondent no. 1 submits that the First Appeal No. 696/2024 is filed in this Court by the appellant arising out of same motor vehicular accident but the claimant is different. He, therefore, requested to tag the said appeal with this appeal.

This appeal be tagged along with First Appeal No. 696/2024 on the same date.
