Learned counsel for the applicant-appellant submits that in terms of the Judgment of this Court in the case of Balasaheb Khade Vs. State of Maharashtra [2013 (3) MLJ (Cri.) 99], there is no provision for limitation in filing an appeal if filed by a private party and, therefore, application for condonation of delay was not required to be made.
In view of the present legal position, we accept the contention of learned Adv., for the applicantappellant and waive the office objection about limitation. Criminal Application is disposed of.
Criminal Appeal :
Criminal Appeal be registered as a regular Criminal Appeal.
