Date : 9 th October, 2015 The learned counsel for the appellant has filed a pursis bearing stamp no.10389 of 2015 for withdrawal of the second appeal. The contents of the pursis are reproduced below : "The appellant submits that the managing/elected body of the Respondent APMC of the year 2002 does not survive and as on today the charge is with the Administrator as well as the transaction in question took place outside the Agricultural Market Produce Committee area of Murtizapur, Dist. Akola. The present matter is already admitted but the appellants do not want to prosecute the Second Appeal as on today as there is no elected body of the Agricultural Market Produce CommitteeMurtizapur, Akola. Hence the present appeal be permitted to be withdrawn with liberty to file fresh proceeding as and when the cause of action arises."
