The applicant in the present proceedings has challenged his conviction by the trial Court for offence punishable under Section 138 of the Negotiable Instrument Act, 1881. The conviction has been maintained by the appellate Court. A joint pursis dated 28.08.2015 has been filed stating therein that an amount of Rs. 9,00,000/- has been paid to the respondent No. 1 by way of full and final settlement. A joint pursis is signed by the applicant and representative of the respondent No. 1 as well as their respective counsel. In view of amicable settlement between the parties, in terms of Section 147 of the said Act the offence under Section 138 of the said Act, stands compounded. The statements made in the joint pursis on behalf of the parties are accepted. In view of compounding of aforesaid offence, the conviction of the applicant is set aside. The amount of Rs. 1,00,000/- deposited by the applicant pursuant to the orders dated 01.08.2014 before the
2808revn138.12 Sessions Court at Amravati is permitted to be withdrawn by the applicant. Revision application stands disposed of in aforesaid terms. JUDGE svk
