DATED : 06-02-2015 Shri M.P. Khajanchi, the learned Advocate for the appellant, on instructions, seeks permission to withdraw the application (Exhibit 5) filed by the appellant before the trial Court on which the impugned order is passed. Shri C.V. Kale, the learned Advocate for the respondents has objection for the withdrawal of the application by the appellant. However, I see no impediment in granting permission to the appellant to withdraw the application. The request is accordingly granted. In view of the withdrawal of the application, the order passed on it becomes non est and consequently the appeal does not survive.
The appeal is disposed accordingly. No costs. Civil Application (CAO)No.90 of 2014.
In view of the disposal of the appeal, the civil application is rendered infructuous and is disposed accordingly.
