DATED : AUGUST 16, 2016 Heard learned Counsel for the applicant and the learned A.P.P. for the State. Perused the reply of the prosecution and the case-diary.

It is seen from the case-diary that although some labourers, who were already dead, were shown to be engaged and worked for some days, actual payment of the labour charges was not made to them. It appears that this act committed by the applicant has not been viewed seriously by the Department and the Department has taken it only as an irregularity. This is obvious from the fact that admittedly no coercive action in service has been taken against this applicant and only a Departmental Enquiry has been ordered. In these circumstances, I am of the view that no purpose would be served by rejecting this application. Hence, the order.:

The application is allowed and the interim bail granted to the applicant by this Court on 09/8/2016 is hereby confirmed on the same conditions.
