Heard Shri Anand, learned Advocate for the petitioner and Shri Kadukar, learned Assistant Government Pleader for the respondents.
Upon instructions, learned Advocate for the petitioner states that petitioner is not interested in claiming pension due to his father i.e. adoptive father and will remain satisfied if status as Freedom Fighter of his father is declared and accepted by the respondents by issuing appropriate certificate. Learned Assistant Government Pleader submits that the petitioner being adoptive son cannot claim such status.
Because of limited prayer made at the threshold, it is apparent that we need not delve into the objection raised by the respondents.
If adoptive father of the petitioner late
WP4844.16 Shri Nihal Kallu Gawali as a freedom fighter, the respondents cannot have any objection to acknowledge it by issuing necessary certificate. We therefore direct the respondents to examine the said status of late Shri Nihali Gawali within three months from today and to issue necessary certificate in that respect.
The petition is thus partly allowed and disposed of. No costs.
