A small question is involved in the present petition whether the learned State Commission is right in asking the petitioner to deposit complete decreetal amount in revision petition filed by the petitioner wherein the challenge was to order granting conditional bail, asking the petitioner to deposit Rs.2,00,000/- as a condition for bail. 3.

The learned counsel for the respondent fairly conceded that in a revision filed by the petitioner, the Commission ought not to have passed such order but to only deal with the legality of the order imposing a condition to deposit Rs.2,00,000/-, while granting bail. 4.

In the circumstances, the impugned order dated 02.07.2024, passed by the State Consumer Disputes

5.WP.581.25.odt Redressal Commission Maharashtra Nagpur Circuit Bench Nagpur in Revision Petition No.RP/24/23, is hereby quashed and set aside to the extent directing the petitioner to deposit the balance decreetal amount within a period of three months, after depositing Rs.1,00,000/- as a condition for grant of bail.

As far as deposit of Rs.1,00,000/- is concerned, since the petitioner has already deposited this amount, this order will operate to the balance decreetal amount as mentioned in the operative part of the order. Accordingly, the writ petition is disposed of in above referred terms.
