Heard Shri J.B. Kasat, Advocate for the petitioner, Shri N.R. Saboo, Advocate for respondent No.1 and Ms. S.Z. Haider, A.G.P. for respondent No.2. The learned Advocate for the petitioner / employer and the learned Advocate for the respondent No.1 / employee submit that in Writ Petition No.1309/2008 and other connected matters challenges on the basis of the provisions of Zilla Parishad Contract Services Rules, 1963 were raised and after considering the facts, this Court recorded that the employees are entitled for permanency from the date of appointment, however, the monetary benefits are granted from the date of filing of the complaint before the Industrial Court. The learned Advocates submitted that the present petition can be disposed in terms of the above referred judgment.
The impugned order passed by the
2 wp5481.16 Industrial Court directing the conferral of permanency on the respondent No.1 / employee from the date of his appointment is confirmed. It is directed that the respondent No.1 / employee will be entitled for the monetary benefits from the date of filing of the complaint before the Industrial Court. With this modification, the order passed by the Industrial Court is maintained. The petition is disposed in the above terms. In the circumstances, parties to bear their own costs. JUDGE Tambaskar.
