By this writ petition, the petitioner seeks a direction to the respondent no.1-State to decide the proposal sent by the Municipal Council, Dhamangaon Railway, dated 13.10.2005. The learned Assistant Government Pleader states, on instructions, that the proposal of the Municipal Council, dated 13.10.2005, has been rejected by the State Government by an order dated 10.10.2006.

Since the proposal of the petitioner has been rejected and it is the case of the petitioner that the petitioner was not aware about the rejection of the proposal as the order was passed without hearing the petitioner, the learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to file a petition challenging the rejection order.

Permission and liberty, both, are granted as prayed for.

The writ petition is disposed of as withdrawn with liberty as aforesaid.
