Rejection of application for amendment to the written statement, filed at the stage of appeal came to be rejected on the ground that the proposed amendment relates to the fact which were in existence prior to filing of the suit and even after the appeal filed in 2011 no application was moved for seven years.

After going through the proposed para 4-A stated in the application for amendment, I have no hesitation to hold that the learned Trial Court has rightly rejected the application. In the circumstances, the writ petition is dismissed.
