Apprehending arrest in connection with Crime No.250/2023, registered with Police Station Hiwarkhed, District Akola, for the offence punishable under Sections 188, 328, 272, 273 of the Indian Penal Code read with Sections 26, 27, 30(2)(a) and 59 of the Food Safety and Standards Act, 2006, the present application for anticipatory bail has been filed.

02] Heard the learned Counsel for the applicant as well as the learned A.P.P. for the State.

03] Having gone through the case diary, it appears that on secrete information received by the police staff, they intercepted a Bolero Vehicle bearing No. MH-28/BB/0897 and found contraband smokeless tobacco (Gutka) worth Rs.4,51,430/- therein. The contraband smokeless tobacco and the vehicle were seized by drawing panchnama. On the statement of the driver of the vehicle i.e. coaccused-Narayan Zadokar, the applicant has been named in the F.I.R. Except that statement of the co-accused, there is nothing against the applicant. Seizing of smokeless tobacco and the vehicle itself goes to

31.aba.495.23 2/2 show that the investigation is almost completed. Nothing is required to be seized from the present applicant. The applicant has fixed place of abode. There is no likelihood that the applicant will flee away from justice. In view of above, the application deserves to be allowed. 04] Hence, the application is allowed.
