By this petition, the petitioner seeks a direction to the respondent no.1-National Highway Authority of India to take immediate action against the respondent no.3 in respect of the illegal construction made by the respondent no.3 within forty meters from the middle line of the National Highway No.7. On hearing the learned counsel for the petitioner and on a perusal of the documents annexed to the writ petition including the photographs, it appears that the relief sought by the petitioner cannot be granted in exercise of the writ jurisdiction. The petitioner is free to file appropriate proceedings to ventilate his grievance.

We dismiss the writ petition with no order as to costs. The points raised in the petition are kept open. JUDGE JUDGE APTE
