The learned Counsel for the petitioner on instructions seeks leave to withdraw the present petition with liberty to file appeal against the orders impugned. The learned Counsel for the petitioner, however, submits that the petitioner, without prejudice to his rights is willing to deposit certain amount of penalty. It is submitted that subject to deposit of such amount, the vehicle be released as the livelihood of the petitioner is dependent upon the said vehicle.

In the facts and circumstances of the case, the respondent no.3-Tahsildar, Yavatmal shall release the vehicle in question, subject to deposit of Rs.2,00,000/- with the office of the Tahsildar, Yavatmal.

The petitioner shall execute the bond before the respondent No.3-Tahsildar in terms of Section 48(3)(2) of the Maharashtra Land Revenue Code, 1966.

iv.

If the appeal against the order impugned is filed within a period of two weeks from today, then the same shall be treated as filed within a period of limitation. v.
