By this petition, the petitioner challenges the select list-wait list of the candidates for appointment on the post of Junior Clerk in the District Court, Akola.

Shri Mirza, the learned counsel for the respondents, states that though there is no merit in the submissions made on behalf of the petitioner and though the said fact can be substantiated from the original record, the writ petition can be disposed of, as the name of the petitioner appears in the list of selected candidates in Phase-II.

Shri Dhore, the learned counsel for the petitioner, states that if the name of the petitioner finds place in the select list of Phase-II, the grievance of the petitioner would not survive as he stands selected.

By accepting the statement made on behalf of the respondents, we dispose of the writ petition with no order as to costs.
