CORAM : B.R. Gavai & V.M. Deshpande, JJ.

DATED : September 22, 2016.

1.

The present public interest litigation has been filed with a grievance that the water supply scheme for village Pimpalgaon, district Akola, was not completed and there was misappropriation in the execution of the said scheme.

2.

This Court vide order dated 10.12.2014 had directed the Superintendent Engineer, Maharashtra Jeevan Pradhikaran, Akola to make an enquiry into the allegations made by the petitioner.

3.

The perusal of the enquiry report would reveal that the amount spent on the scheme was not more than the amount which was paid from the public exchequer.

4.

In that view of the matter, there is no substance into the allegations made with regard to misappropriation in the execution of the said scheme. However, it is in the interest of the residents of the village that the said scheme which is incomplete, must

be completed at the earliest.

5.

In that view of the matter, we direct the Gram Panchayat to submit a proposal for completion of the project to the Zilla Parishad, Akola within a period of four weeks from today. On receipt of the proposal from the Gram Panchayat, the Zilla Parsihad, Akola, shall execute and complete the project within a period of six months from the receipt of the proposal. We make it clear that paucity of fund will not be a ground for noncompletion of the project within the stipulated period fixed by this Court.
