By this writ petition, the petitioner seeks a declaration that the contractual/temporary appointment of the respondent nos.3 to 6 on the posts of Clerk and Peon in the office of the Directorate of Textiles, Nagpur is bad in law. Shri Joshi, the learned Assistant Government Pleader appearing for the respondent nos.1 and 2, states on instructions that the petition is misconceived as the same is based on the wrongful assumption that the respondent nos.3 to 6 are appointed on the posts of Clerk and Peon in the establishment of the respondent no.2.
The learned counsel for the respondent nos.3 to 6 has tendered an affidavit-in-reply in the Court today. The same is accepted on record. It is stated that the petition is based on the imagination of the petitioner as the respondent nos.3 to 6 are never appointed on the posts of Clerk and Peon.
In view of the statements made on behalf of the respondents, we dismiss the writ petition with costs. JUDGE JUDGE APTE
