1.
After the direction issued by the Division Bench of this court for making fresh enquiry by the Chief Executive Officer, while setting aside the enquiry made under Section 39 of the Maharashtra Village Panchayat Act, 1958, the enquiry was conducted by the Block Development Officer, Panchayat Samiti, Manora and submitted the report to the Chief Executive Officer, who further submitted it to the Divisional Commissioner in a proceeding filed under Section 39 (1) of the Maharashtra Village Panchayat Act for removal of the petitioner as a member of the Gram Panchayat, Gadegaon, Post-Dhanora (Ghadge) TahsilManora, District-Washim. 2.
The petitioner thereupon moved an application for calling a fresh report as the Block Development Officer, Panchayat Samiti, Manora has not empowered to make enquiry and submit the report. This contention of the petitioner came to be rejected by the Divisional Commissioner vide order dated 12.07.2023 and

4.
In that view of the matter, the writ petition is disposed of with a direction to the Divisional Commissioner to decide the application filed by the respondent nos.4 and 5 under Section 39
